Insurer denies liability in dentist's sexual assault lawsuits

American Insurance says it shouldn't be held liable for damages that a Pennsylvania oral surgeon must pay in civil lawsuits claiming he sexually assaulted patients, according to a story in the Pittsburgh Tribune-Review.

Robert John Boyda Jr., DDS, of Mt. Lebanon was acquitted in 2009 of criminal charges that he drugged and molested 17 female patients. At least eight of those patients subsequently filed civil lawsuits seeking damages for the alleged assaults, according to the insurance company's federal lawsuit, which was filed December 10.

Sexual acts are not dental services and shouldn't be covered by Dr. Boyda's dental services insurance policy, the lawsuit states.
