A federal judge in Orange County, CA, has dismissed all claims of Biolase's lawsuit against Fotona.
Biolase's lawsuit, filed in February, had challenged Fotona's statements that its lasers were faster for hard-tissue dental applications than Biolase's lasers. The court concluded that Biolase has failed to state a claim for false advertising since Fotona's advertising statements are accurate restatements of conclusions in scientific journal articles, according to a press release issued by Fontana.
The company pledged to continue to vigorously defend its products, and take action against false or misleading claims.
