NY dentist sues for $75M over Medicaid fraud charges

A New York dentist who says his career was ruined by a Medicaid fraud suit filed by former state Attorney General Eliot Spitzer will get a chance to clear his name, according to a story in the New York Daily News.

Leonard Morse, DDS, filed a $75 million lawsuit claiming he was the victim of malicious prosecution in 2006 when Spitzer charged the dentist with filing more than $1 million in false billings for dentures.

A federal judge has ruled that Dr. Morse's case should be heard by a jury.

The fraud case against Dr. Morse failed after Spitzer's aide John Fusto, who worked in New York's Medicaid fraud unit, admitted that billing records only showed false billings of $3,000, the story said. Dr. Morse, who was found innocent of all charges, is also suing Fusto.
