Delta Dental patient portal users may be owed cash for privacy settlement

A class action lawsuit against Wyssta Services has been reached, and patients who maintained a my.deltadentalcoversme.com account between 2021 and 2025 may be eligible for a settlement payment but have until August to act. The lawsuit settlement was announced in a press release dated June 18 from the Kroll Settlement Administration, who is overseeing the settlement.

The settlement was reached in the case of Feeler v. Wyssta Services Inc., which was filed in the Circuit Court of Sangamon County for the State of Illinois. The suit alleges that Wyssta Services violated the Electronic Communications Privacy Act and the Illinois Eavesdropping Statute when it purportedly installed advertising and analytics tracking technology, including cookies and pixels, on a website Wyssta Services operates for certain Delta Dental plan members. The technology, the suit alleges, was installed without users’ knowledge or consent.

Who qualifies for the settlement payment?

Users of my.deltadentalcoversme.com between January 23, 2021, and January 23, 2025, may be eligible for a settlement payment. Wyssta Services will pay nearly $13 million into a settlement fund, Kroll said in the release. 

Individuals who are deemed eligible and who submit a valid claim form could receive up to $16.50, the release states. Payments could be reduced if the volume of valid claims exceeds available funds, Kroll said.

Key deadlines

The deadline to file a claim, opt out, or submit an objection is Thursday, August 20, 2026. Patients who do not respond will not receive a payment but remain bound by the agreement’s terms.

A final hearing is scheduled for September 9, 2026, at which time the court will decide whether to approve the settlement.
