Dentists filed class-action lawsuits against Delta Dental organizations in California, Wisconsin, Michigan, and Massachusetts on April 30, alleging anticompetitive conduct that suppressed reimbursement rates and limited competition in dental insurance markets.
The state filings follow a September 2025 federal ruling that denied certification of a nationwide class in a related antitrust case pending since 2019. With the federal case moving forward only on individual claims, the new complaints seek classwide relief under state law.
The lawsuits allege that Delta Dental entities hold more than 50% market share in each state, giving them leverage to reduce reimbursement rates over time -- even as premiums increased -- while in-network dentists had limited ability to opt out without losing a substantial share of their patient base.
Each complaint seeks injunctive relief, monetary damages, and measures to restore competition.
