Oral surgeon agrees to pay $532K to settle case

An oral surgeon in Oklahoma has agreed to pay $532,055 to the state to resolve claims that he allegedly fraudulently billed for excess units of anesthesia and tobacco cessation counseling for non-tobacco users, according to the Oklahoma Attorney General.

Dr. Rocky Cullens, who operates Stonewood Hills Oral Maxillofacial Surgery in Broken Arrow, OK, has agreed to pay to resolve allegations he violated the Oklahoma Medicaid False Claims Act. The payment includes $354,703 that he received for fake claims and $177,351 in penalties, according to a press release from the attorney general dated July 31.

Between January 2021 and July 2024, Cullens allegedly submitted fraudulent claims to SoonerCare, Oklahoma’s Medicaid program, by double billing and upcoding patient visits, billing excess units of general anesthesia, and billing for tobacco cessation counseling for non-tobacco users, according to the press release.

The investigation into Cullens began after authorities received a referral from the Oklahoma Health Care Authority.
